Conclusion of the agreement

Only these General Terms and Conditions apply to the sale of our products. Other conditions only apply if they have been recognized by us in writing.

The agreement is concluded exclusively in Dutch.

An order that is binding for you will only be concluded when
you have entered all the information necessary to process the order, you have confirmed that you have taken note of these General Terms and Conditions and you have clicked on the “order with payment obligation” button. The moment you click on the latter button, you conclude the purchase agreement with Bigger Picture Clothing on the basis of the general terms and conditions described here. Until you have clicked this button, you can change and correct the order and the information accompanying your order at any time.

After you have placed your order, you will receive an automatically generated confirmation of receipt of your order by e-mail. This confirmation of receipt contains the details of your order and these General Terms and Conditions again. These General Terms and Conditions can also be read in a downloadable format (PDF) during your visit to our website.

In addition to the reasons stated in the law, Bigger Picture
Clothing may fully or partially terminate the purchase agreement concluded with you if part of the order or all ordered products turn out to be unavailable, despite the website stating that these products are in stock. This may occur in the event that the stock becomes empty after the order, the product is no longer offered or there are other reasons that make delivery impossible. You will receive an email from us if this occurs. If the order has been prepaid, this amount will be transferred to your account as soon as possible.

Availability and delivery time of products

If one or more of the products you ordered are no longer available at the time of your order for whatever reason, we will unfortunately not be able to fully fulfill your order. We reserve the right to choose to partially execute or completely reject the order in such a case. We will tell you about that

If the product you ordered is available, the time until delivery to the address you specified is approximately 2 to 5 working days after receipt of your order in the normal course of business in the Netherlands. Outside the Netherlands, 5 to 7 working days should be taken into account.

Exchanges and returns policy

If you would like to exchange for a different size, you can request this using the returns form. Clearly indicate the new size. If in stock, it will then be sent after processing your return, which takes place within 12 working days. If the requested size is unfortunately not available at the time of processing, we will automatically refund you. In case you want to exchange for a different model or color, you can return the item for a refund and place a new order.

Liability

These General Terms and Conditions do not limit or exclude Bigger Picture Clothing's liability for matters that we cannot limit or exclude by law.

Our total liability to you for any loss or damage arising from your order with Bigger Picture Clothing is limited to the total amount of your order.

Right of withdrawal

You have the right to withdraw from the purchase agreement within 30 days without giving reasons.

The withdrawal period expires 30 days after the day on which you physically receive the product you ordered. To exercise the right of withdrawal, you must inform us

If you revoke the purchase agreement, you will receive back from us all payments you have made up to that point, including delivery costs, without delay and in any case no later than 30 days after we have been informed of your decision to revoke the purchase agreement. We will refund you with the same payment method as you used
original transaction, unless you have expressly agreed otherwise; in any case, no costs will be charged for the refund. We will wait with reimbursement until we have received the products back from you in good condition.

Make sure that you return or hand over the products to us immediately, and in any case no later than 30 days after the day on which you communicate your decision to revoke the purchase agreement to us. You are on time if you return the goods before the 30-day period has expired.

We will not bear the costs of returning the goods.

You are only liable for any depreciation in value of the products resulting from the use of the products.

Price

All prices stated for products in the Webshop always include the applicable statutory sales tax (VAT).

In addition, home deliveries with PostNL are €6.75 and free from a minimum order value of €100.

Payment options

You can choose between different payment methods when paying
to elect:

• Credit card (Visa, MasterCard, American Express)
• PayPal; the details of your bank or credit cards are registered with PayPal according to your own instructions.
• iDeal

Please note that you may incur additional costs for transfers, maintaining a bank account, etc. based on agreements concluded with banks and other credit institutions.

We reserve the right to limit the use of the above payment methods per individual to one or more payment methods.

If you pay for payment by means of an invoice, you must pay this within 30 days of receiving the products.

In the event of late payment, you are contractually liable to pay interest on the amount to be paid. The amount owed by you in the event of late payment will also be increased by extrajudicial collection costs in accordance with the legal provisions. These costs will be charged 30 days after notice of default.

Retention of title

Until full payment has been made, the delivered products remain our property.

Intellectual property rights

The website operated by us as well as its entire content
thereof, in particular texts, photos, images, graphics
performances, printing, textile designs, films, presentations, sound, illustrations and any software as well as all brands and/or models, in particular intellectual property rights, name and image rights, brands and/or registered or unregistered models, are all owned by industrial property rights protected against unlawful use. Any use, except for selecting and purchasing an item, requires prior written permission from us or, if the relevant rights
are not with us, from the rightful owner.

Dutch law applies to this agreement.
